The ECB Art App is provided to you by the European Central Bank (ECB) and its installation on your device is free and voluntary.

The ECB Art App does not collect any of your personal data; there is no facility to process user data within the app.

You can download the ECB Art App on your device via a third-party service, either the Apple App Store or the Google Play Store. Any use of personal data by App Store is conducted according to Apple’s privacy policy and the ECB does not endorse or take responsibility for this processing of your personal data. Any use of personal data by Google Play Store is conducted according to Google’s Privacy Policy and the ECB does not endorse or take responsibility for this processing of your personal data.

The information contained in the ECB Art App mobile application (hereinafter the ‘app’) is for general information purposes only.

Conditions of use

The European Central Bank would like to thank you for choosing this app. The European Central Bank, Sonnemannstrasse 20, 60314 Frankfurt a.M., Germany (hereinafter the ’ECB’), has made this app available to you free of charge under the following conditions.

Copyrights and rights of use

This app and its content are protected by copyright and by other intellectual property rights. The ECB grants you the simple right to use the app for the period in which the app is available. This app and its content are solely intended for personal, non-commercial use. Unless required by law, any further use, including copying, distribution, sub-licensing, decompiling or any form of commercial use, requires the prior written consent of the ECB or the relevant copyright owner.

In particular, the app's content, including any artwork, is subject to copyright and other intellectual property rights of the ECB or third parties. The copyright of all material, including text, images, audio, and video, is owned by the ECB unless specifically stated otherwise. All attempts have been made to locate the holders of the rights in the works included in the app. Should any have been overlooked, please contact the Art Project Office at the ECB via email at art@ecb.europa.eu.

The copyright notices within the app apply to the app and its content. Any reproduction, in whole or in part, transmission, including by use of technical means, modification, and use of any information displayed on this app as part of a link to or from the app for public or commercial purposes is prohibited without the prior written consent of the ECB or the relevant copyright owner. You may only download content from this app for your personal use if you comply with all copyright notices or other notices on intellectual property rights, include references to such copyrights or intellectual property rights in each copy and do not use any of the downloaded content in any other work or publication, irrespective of the medium. Any opinion contained in this app exclusively reflects the opinion of the author expressing it (and not necessarily the opinion of the ECB) and is subject to change without prior notice.

Trademarks and brandmarks

The ECB logo is protected as an emblem under Article 6ter of the Paris Convention for the Protection of Industrial Property.The content of this app may not be construed as a license or right to use any part of the logo or the logo itself.

Restrictions of use and additional costs

The system and installation guidelines must be observed. The ECB assumes no responsibility for any other use of, or for the compatibility with, other devices.

If the user uses third-party services in connection with the use of this app and incurs a mandatory charge as a result of those services, then the user is responsible for those charges incurred with the third party service provider. The ECB is not responsible for any additional costs that may be incurred in connection with the use of this app, such as operational costs that may be incurred from the use of mobile internet. Furthermore, the ECB does not assume responsibility for any third-party content that may be accessed via the app, for example via links to other websites.

Limitation of liability and warranty

The ECB shall have no liability to the user or any third party for any loss or damage arising in connection with the use of this app and shall not be subject to any compensation claims made in connection with the use of this app, unless it can be proved that the ECB acted with negligence, intent, or that the ECB deliberately concealed a defect of title or damages that caused a loss of life, personal injury, damage to health, or a breach of product liability law.

If other obligations exist that have not been covered by the limitation of liability clause above, the ECB may only be held liable in cases of slight negligence or when key contractual obligations have been breached. Liability in these circumstances is limited to typical, foreseeable damage.

There are no guarantees or warranted characteristics in connection with the app. All warranty rights and rights arising in connection with any defect are hereby expressly excluded to the extent permissible by law. The ECB is only responsible for restoring the functionality of the free app if, at the time the app is provided, a defect has been intentionally concealed or negligently overlooked. In such cases, provided no party has terminated the agreement, the user only has the right to request the subsequent delivery of a functioning app. All other claims in connection with defects are hereby excluded.

Responsibility for content

The ECB undertakes all reasonable measures to gather information from sources it considers reliable. Nevertheless, the ECB offers no guarantee, either explicitly or implicitly, that the information and opinions contained in this app are correct, reliable, up to date or complete. The information contained in this app does not constitute advice on investment, legal, tax or other matters. The ECB assumes no liability whatsoever for any direct or indirect loss, liability, cost, expense or damage of any kind (whether caused by negligence or otherwise) arising in connection with your reliance on content published in this app.

Confidentiality and integrity

The ECB will take reasonable measures to protect its app against hackers and viruses. However, the ECB is unable to guarantee the confidentiality and integrity of internet communications or the security of the user's device. For this reason, the ECB is not responsible for the confidentiality and integrity of internet communications or the security of the user’s device and recommends that all users take appropriate measures to protect their devices from access by third parties. Such measures may include password protection and anti-virus software.

The use of this app is exclusively subject to substantive German law. Conflict-of-law regulations are excluded. Content is made available exclusively for areas covered by the scope of German law. Any matter in dispute shall be referred to the jurisdiction of the ordinary courts (Amtsgericht or Landgericht) in Frankfurt am Main, Germany.
